1. Parties and service
The platform operates an in-app application for self-guided, digital audio content. In phase 1, Premium is offered: a subscription billed monthly that unlocks the published locations of all cities. The content is used in the mobile app.
2. Handling through the app store
Premium is bought exclusively within the app, through the billing system of the respective app store. The store collects the amount, remits the VAT and issues the receipt; towards the customer it is therefore the billing merchant (merchant of record). Guides are content suppliers and not sellers towards tourists.
3. Accounts
Self-registration with e-mail address and password. Tourists are responsible for the security of their own login details. How we handle the data that arises in the process is set out in the Privacy notice.
4. Purchases and the digital nature of the content
Premium is digital content that is used in the app. The price is shown including VAT and is EUR 6.99 per month. The price the app store states for the respective country governs; the store collects and remits the VAT.
5. Consent to immediate access on purchase
Access begins immediately with the purchase and applies to the billing period paid for. Before the purchase, the store's checkout points this out, and the customer expressly confirms there that immediate access to digital content begins and that no refund is offered for a change of mind.
Premium is digital content that is supplied immediately. In the store's checkout you expressly agree that provision begins immediately, and you confirm that you thereby lose your right of withdrawal as soon as the service has been supplied in full (Section 356(5) BGB (German Civil Code)).
Because Premium is a subscription and therefore a continuing obligation, you can withdraw from the contract within 14 days. If you have requested that the service begin before then, you owe a proportionate amount for the period used up to that point (Section 357 BGB). A refund is processed through the app store you bought through.
6. Term and cancellation
Premium runs monthly and renews automatically until it is cancelled. Access covers the published locations of all cities and follows the period that the app store reports as paid. Cancellation happens in the app store; access remains in place until the end of the month already paid for.
Access is provided as protected streaming. In addition, you can download content to your device for offline use within a running subscription.
7. Content ownership and warranty
Platform locations are the platform's own content. Guide content (a later phase) remains the property of the respective guides, who are answerable for its lawfulness, accuracy, quality and intellectual property rights; the platform receives distribution rights in order to sell access.
8. Permitted use
No misuse of protected content. Content downloaded for offline use is limited to your personal use, and only for as long as your subscription entitles you to it. So that a device without a connection is not locked out, downloads stay playable for up to 30 days after the app last confirmed your subscription; as soon as the app can confirm again, that answer applies.
9. Refunds, statutory rights, support remedies
See Withdrawal & Refunds. Statutory rights are unaffected.
10. Account deletion
See Delete your account.
11. Liability, applicable law, dispute resolution, changes
Liability. We are liable without limitation in cases of intent and gross negligence, and for damage arising from injury to life, body or health. In cases of ordinary negligence we are liable only for the breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may rely, and limited in amount to the foreseeable damage typical of this type of contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
Content and orientation. The audio content serves to inform. It does not replace route directions or an assessment of the situation on the ground; attention in traffic and the judgement of hazards remain with you.
Applicable law and place of jurisdiction. German law applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected. For consumers there is no deviating place of jurisdiction; the statutory rules apply.
Changes to these terms. We will inform you at least 30 days before a change takes effect, by e-mail or in the app. If you do not object by the date stated, the new version is deemed accepted; we point this out separately in the notice. If you do object, you can end the contract at the end of the month paid for.
